An individual will contact ACAS either by phone or by completing an Early Conciliation form online. Once the Early Conciliation form has been submitted to ACAS, ACAS will contact the prospective claimant to explain the process and take information about the claim. .   Early conciliation is a free service offered by ACAS. It was previously available on a purely voluntary basis, however, from May it became mandatory to contact ACAS before lodging a claim. This was in an effort to encourage early engagement and settlement between the parties, thereby, removing the need to pursue claims in the Employment Tribunal.

An excellent post. Other issues with Acas Early Conciliation are: (1) naming multiple Respondents. Sometimes you might want to sue both your employer and an individual who has harassed you. To be certain of being allowed to sue both, you need to complete an Acas Early Conciliation Form for each of them. The latest figures published by ACAS go some way to answering this. The key statistics show that: In the first 6 months, ACAS were contacted just o times in respect of early conciliation; Of that contact about 1, were multiple claims, covering about 8, potential claimants; 3% of early conciliation requests came from the employer.

There is a lot of information available about the new ACAS early conciliation process. For this reason we have not repeated it all here. If you want to know more information about early conciliation, our suggestion would be to go to the experts – ACAS. They have an excellent website which you should visit: If you are still. You have probably heard already that from 6 May , conciliation via ACAS becomes mandatory for claimants wishing to bring employment tribunal claims. If so, you may have heard of the new rules being referred to as "mandatory conciliation" or "early mandatory conciliation". As an employer, you may be wondering how a conciliation process can be mandatory.
